Article R4234-45 of the French Public Health Code

The notification of the decision of the National Disciplinary Board or of the order of its chairman indicates that an appeal in cassation may be lodged with the Conseil d’Etat through a lawyer at the Conseil d’Etat and at the Cour de cassation within two months of receipt of this notification.

The letter of notification shall state that the additional time limits for distance apply in accordance with the provisions of articles 643 and 644 of the Code of Civil Procedure.

If the effect of the appeal is to suspend enforcement of the decision, the notification shall state this.

Otherwise, the notification states that the appeal has no suspensive effect and points out that a stay of execution may be requested from the Conseil d’Etat under the conditions defined in articles R. 821-5 and R. 821-5-1 of the Code of Administrative Justice.

La notification de la décision de la chambre de discipline nationale ou de l’ordonnance de son président indique qu’un recours en cassation peut être formé devant le Conseil d’Etat par le ministère d’un avocat au Conseil d’Etat et à la Cour de cassation dans le délai de deux mois à compter de la réception de cette notification.

La lettre de notification indique que les délais supplémentaires de distance s’appliquent conformément aux dispositions des articles 643 et 644 du code de procédure civile.

Dans le cas où le pourvoi a pour effet de suspendre l’exécution de la décision, la notification le précise.

Dans le cas contraire, la notification indique que le pourvoi n’a pas d’effet suspensif et rappelle que le sursis à exécution peut être demandé au Conseil d’Etat dans les conditions définies aux articles R. 821-5 et R. 821-5-1 du code de justice administrative.
