Article R4234-46 of the French Public Health Code

I.-A pharmacist who is the subject of a complaint before the national disciplinary chamber and who has not lodged a defence in due form shall be entitled to lodge an objection to the decision rendered by default.

The objection shall have suspensory effect.

II.-When the decision of the national disciplinary chamber is subject to opposition, the notification sent to the accused pharmacist will state that the opposition may be lodged within a period of five days.

Unless otherwise provided for in this sub-section, the lodging of an opposition will follow the rules relating to the lodging of an appeal. The provisions of sections 3 to 5 of this chapter shall also apply.

III.-The decision admitting the opposition shall, if necessary, put the parties back in the same position as before.

IV -The judgements and orders of the Disciplinary Boards of first instance are not subject to opposition.

I.-Le pharmacien qui, mis en cause devant la chambre de discipline nationale, n’a pas produit de défense en forme régulière est admis à former opposition à la décision rendue par défaut.


L’opposition a un effet suspensif.


II.-Lorsque la décision de la chambre de discipline nationale est susceptible d’opposition, la notification adressée au pharmacien mis en cause mentionne que l’opposition peut être formée dans un délai de cinq jours.


Sauf dispositions contraires prévues par la présente sous-section, l’introduction de l’opposition suit les règles relatives à l’introduction de l’instance d’appel. Sont de même applicables les dispositions des sections 3 à 5 du présent chapitre.


III.-La décision qui admet l’opposition remet, s’il y a lieu, les parties dans le même état où elles étaient auparavant.


IV.-Les jugements et ordonnances des chambres de discipline de première instance ne sont pas susceptibles d’opposition.
