Article R4234-9 of the French Public Health Code

Where two or more Disciplinary Boards of First Instance are simultaneously seised of separate but related applications that normally fall within their respective jurisdictions, each of the presidents concerned shall refer the matter to the president of the National Disciplinary Board and send him or her the application file.

The presidents of the Disciplinary Divisions of first instance hearing the other claims shall be notified of the referral order and shall forward to the president of the National Disciplinary Chamber the file on the claim submitted to their division.

The president of the National Disciplinary Chamber shall rule on the existence of a related link and shall determine which Disciplinary Division of first instance has jurisdiction to hear the claims.

Orders made pursuant to the two preceding paragraphs shall be notified to the parties without delay. They are not subject to appeal and do not have the force of res judicata.

Lorsque des chambres de discipline de première instance sont simultanément saisies de demandes distinctes mais connexes, relevant normalement de leur compétence respective, chacun des présidents intéressés saisit le président de la chambre de discipline nationale et lui adresse le dossier de la demande.

L’ordonnance de renvoi est notifiée aux présidents des chambres de discipline de première instance saisies des autres demandes qui transmettent au président de la chambre de discipline nationale le dossier de la demande soumise à leur chambre.

Le président de la chambre de discipline nationale se prononce sur l’existence d’un lien de connexité et détermine la chambre de discipline de première instance compétente pour connaître des demandes.

Les ordonnances prises en application des deux alinéas précédents sont notifiées sans délai aux parties. Elles ne sont pas susceptibles de recours et ne sont pas revêtues de l’autorité de chose jugée.
