Article R4235-1 of the French Public Health Code

The provisions of this chapter constitute the code of ethics for pharmacists provided for in article L. 4235-1.

The provisions of the Code of Ethics are binding on all pharmacists and private practice companies registered on one of the Rolls of the Order.

They also apply to pharmacy students authorised to carry out locum work under the conditions laid down by the provisions adopted in application of articles L. 5125-21 and L. 6221-11.

Infringements of these provisions are subject to the disciplinary jurisdiction of the ordre, without prejudice to any criminal proceedings that may result.

Whatever the legal entities within which they practise, pharmacists may not consider this circumstance as exempting them personally from their obligations.

Pharmacists who carry out a public service mission, in particular in a public health establishment or in a public medical biology analysis laboratory, and who are registered as such on one of the Rolls of the Order, may only be brought before a disciplinary chamber at the request or with the agreement of the administrative authority to which they are answerable.

Les dispositions du présent chapitre constituent le code de déontologie des pharmaciens prévu à l’article L. 4235-1.

Les dispositions du code de déontologie s’imposent à tous les pharmaciens et sociétés d’exercice libéral inscrits à l’un des tableaux de l’ordre.

Elles s’imposent également aux étudiants en pharmacie autorisés à faire des remplacements dans les conditions fixées par les dispositions prises en application des articles L. 5125-21 et L. 6221-11.

Les infractions à ces dispositions relèvent de la juridiction disciplinaire de l’ordre, sans préjudice des poursuites pénales qu’elles seraient susceptibles d’entraîner.

Quelles que soient les personnes morales au sein desquelles ils exercent, les pharmaciens ne sauraient considérer cette circonstance comme les dispensant à titre personnel de leurs obligations.

Les pharmaciens qui exercent une mission de service public, notamment dans un établissement public de santé ou dans un laboratoire d’analyses de biologie médicale public, et qui sont inscrits à ce titre à l’un des tableaux de l’ordre, ne peuvent être traduits en chambre de discipline que sur la demande ou avec l’accord de l’autorité administrative dont ils relèvent.
