The provisions of this chapter constitute the code of ethics for pharmacists provided for in article L. 4235-1.
The provisions of the Code of Ethics are binding on all pharmacists and private practice companies registered on one of the Rolls of the Order.
They also apply to pharmacy students authorised to carry out locum work under the conditions laid down by the provisions adopted in application of articles L. 5125-21 and L. 6221-11.
Infringements of these provisions are subject to the disciplinary jurisdiction of the ordre, without prejudice to any criminal proceedings that may result.
Whatever the legal entities within which they practise, pharmacists may not consider this circumstance as exempting them personally from their obligations.
Pharmacists who carry out a public service mission, in particular in a public health establishment or in a public medical biology analysis laboratory, and who are registered as such on one of the Rolls of the Order, may only be brought before a disciplinary chamber at the request or with the agreement of the administrative authority to which they are answerable.
