Article R4301-4 of the French Public Health Code

As part of the teamwork between the doctor(s) and the advanced practice nurse(s) in accordance with article R. 4301-1, an organisational protocol is drawn up.

In the “psychiatry and mental health” field of intervention, the organisational protocol is drawn up between one or more psychiatrists and one or more advanced practice nurses.

This protocol specifies:

1° The area(s) of intervention concerned;

2° The arrangements for the care by the advanced practice nurse of the patients entrusted to him or her or whom he or she cares for pursuant to the second paragraph ofarticle R. 4301-3-1;

3° The procedures and regularity of exchanges of information between the doctor and the advanced practice nurse;

4° The procedures and regularity of multi-professional consultation meetings designed to discuss the care of the patients concerned;

5° The conditions for the patient’s return to the doctor, particularly in the situations provided for in articles R. 4301-5 and R. 4301-6 ;

6° When the advanced practice nurse intervenes in application of the second paragraph of article R. 4301-3-1, the arrangements for coordination by a doctor of the individual care of patients.

The organisational protocol is signed by the doctor(s) and the advanced practice nurse(s). The model document provided for in article R. 4301-6, drawn up by the doctor(s) and the advanced practice nurse(s), is appended to the protocol. Where appropriate, the protocol is brought to the attention of the entire healthcare team.

Article R4301-4

Dans le cadre du travail en équipe entre le ou les médecins et le ou les infirmiers exerçant en pratique avancée conformément à l’article R. 4301-1, un protocole d’organisation est établi.

Dans le domaine d’intervention “ psychiatrie et santé mentale ”, le protocole d’organisation est établi entre un ou plusieurs psychiatres et un ou plusieurs infirmiers exerçant en pratique avancée.

Ce protocole précise :

1° Le ou les domaines d’intervention concernés ;

2° Les modalités de prise en charge par l’infirmier exerçant en pratique avancée des patients qui lui sont confiés ou qu’il prend en charge en application du second alinéa de l’article R. 4301-3-1 ;

3° Les modalités et la régularité des échanges d’information entre le médecin et l’infirmier exerçant en pratique avancée ;

4° Les modalités et la régularité des réunions de concertation pluriprofessionnelle destinées à échanger sur la prise en charge des patients concernés ;

5° Les conditions de retour du patient vers le médecin, notamment dans les situations prévues aux articles R. 4301-5 et R. 4301-6 ;

6° Lorsque l’infirmier en pratique avancée intervient en application du second alinéa de l’article R. 4301-3-1, les modalités de la coordination par un médecin, de la prise en charge individuelle des patients.

Le protocole d’organisation est signé par le ou les médecins et le ou les infirmiers exerçant en pratique avancée. Le modèle du document prévu à l’article R. 4301-6, élaboré par le ou les médecins et par le ou les infirmiers exerçant en pratique avancée, figure en annexe du protocole. Le protocole est porté, le cas échéant, à la connaissance de l’ensemble de l’équipe de soins.
