Article R4301-6 of the French Public Health Code

The doctor informs the patient of the planned arrangements for his or her care by the advanced practice nurse. When the patient is an adult subject to a legal protection measure relating to the person, this protocol is also given to the person in charge of such a measure with representation and, if the person concerned expressly consents, to the person in charge of such a measure with assistance. These arrangements are set out in the document appended to the organisational protocol, which is completed and signed by the doctor and given to the patient or, where applicable, to the patient’s trusted support person, legal representative or parents in the case of a minor. This document is placed in the patient’s medical file.

By way of derogation from the first paragraph, when the advanced practice nurse intervenes in application of the second paragraph of article R. 4301-3-1, he/she informs the patient of the planned arrangements for his/her care. He fills in, signs and gives the document, provided for in the appendix to the organisational protocol, to the patient or, where applicable, to his trusted support person, his legal representative or the parents in the case of a minor.

This document specifies the following information:

1° The composition of the team;

2° The frequency with which the doctor wishes to see the patient in consultation;

3° The patient’s right to refuse to be monitored by the advanced practice nurse without any consequences for his or her care, in accordance with article L. 1110-8;

4° The conditions for returning to the doctor, at the decision of the advanced practice nurse, particularly in the situations provided for in the last paragraph of article R. 4301-5 or at the patient’s request;

5° The conditions guaranteeing respect for the confidentiality of the patient’s personal data when it is transmitted between the doctor and the advanced practice nurse.

Article R4301-6

Le médecin informe le patient des modalités prévues de sa prise en charge par l’infirmier exerçant en pratique avancée. Lorsque le patient est une personne majeure faisant l’objet d’une mesure de protection juridique relative à la personne, ce protocole est également remis à la personne chargée d’une telle mesure avec représentation et, si l’intéressé y consent expressément, à la personne chargée d’une telle mesure avec assistance. Ces modalités figurent dans le document prévu en annexe du protocole d’organisation, rempli et signé par le médecin, et remis par ce dernier au patient, ou, le cas échéant, à sa personne de confiance, à son représentant légal ou aux parents lorsqu’il s’agit d’une personne mineure. Ce document est versé au dossier médical du patient.

Par dérogation au premier alinéa, lorsque l’infirmier en pratique avancée intervient en application du second alinéa de l’article R. 4301-3-1, il informe le patient des modalités prévues de sa prise en charge. Il remplit, signe et remet le document, prévu en annexe du protocole d’organisation, au patient, ou, le cas échéant, à sa personne de confiance, à son représentant légal ou aux parents lorsqu’il s’agit d’une personne mineure.

Ce document précise les informations suivantes :

1° La composition de l’équipe ;

2° La fréquence à laquelle le médecin souhaite revoir le patient en consultation ;

3° Le droit de refus par le patient d’être suivi par l’infirmier exerçant en pratique avancée sans conséquence sur sa prise en charge, conformément à l’article L. 1110-8 ;

4° Les conditions de retour vers le médecin, sur décision de l’infirmier exerçant en pratique avancée, notamment dans les situations prévues au dernier alinéa de l’article R. 4301-5 ou sur demande du patient ;

5° Les modalités garantissant le respect de la confidentialité des données personnelles du patient lors de leur transmission entre le médecin et l’infirmier exerçant en pratique avancée.
