The doctor informs the patient of the planned arrangements for his or her care by the advanced practice nurse. When the patient is an adult subject to a legal protection measure relating to the person, this protocol is also given to the person in charge of such a measure with representation and, if the person concerned expressly consents, to the person in charge of such a measure with assistance. These arrangements are set out in the document appended to the organisational protocol, which is completed and signed by the doctor and given to the patient or, where applicable, to the patient’s trusted support person, legal representative or parents in the case of a minor. This document is placed in the patient’s medical file.
By way of derogation from the first paragraph, when the advanced practice nurse intervenes in application of the second paragraph of article R. 4301-3-1, he/she informs the patient of the planned arrangements for his/her care. He fills in, signs and gives the document, provided for in the appendix to the organisational protocol, to the patient or, where applicable, to his trusted support person, his legal representative or the parents in the case of a minor.
This document specifies the following information:
1° The composition of the team;
2° The frequency with which the doctor wishes to see the patient in consultation;
3° The patient’s right to refuse to be monitored by the advanced practice nurse without any consequences for his or her care, in accordance with article L. 1110-8;
4° The conditions for returning to the doctor, at the decision of the advanced practice nurse, particularly in the situations provided for in the last paragraph of article R. 4301-5 or at the patient’s request;
5° The conditions guaranteeing respect for the confidentiality of the patient’s personal data when it is transmitted between the doctor and the advanced practice nurse.
