Article R431-15-4 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of article L. 424-10, as soon as they are granted subsidiary protection, foreign nationals are informed of the procedures enabling them to access the teleservice mentioned in article R. 431-2 in order to submit an application for the issue of the multiannual residence permit mentioned in article L. 424-9.

As soon as this application is submitted, a certificate of extension of the examination of their application mentioned in the second paragraph of article R. 431-15-1, for a renewable period of six months, is made available to them.
As soon as this application is submitted, the prefect will provide a certificate of extension of the processing of the application, as referred to in the second paragraph of article R. 431-15-1, for a renewable period of six months, using this teleservice. This certificate bears the words “has been granted subsidiary protection”.
This document enables them to prove that their residence is legal for the period it specifies and gives them the right to exercise the profession of their choice under the conditions laid down in article L. 414-10.

Pour l’application de l’article L. 424-10, dès que le bénéfice de la protection subsidiaire lui est reconnue, l’étranger est informé des modalités lui permettant d’accéder au téléservice mentionné à l’article R. 431-2 afin qu’il souscrive une demande de délivrance de la carte de séjour pluriannuelle mentionnée à l’article L. 424-9.


Dès la souscription de cette demande, une attestation de prolongation de l’instruction de sa demande mentionnée au deuxième alinéa de l’article R. 431-15-1, d’une durée de six mois renouvelable, est mise à sa disposition par le préfet au moyen de ce téléservice. Cette attestation porte la mention “ a obtenu le bénéfice de la protection subsidiaire ”.


Ce document lui permet de justifier de la régularité de son séjour pendant la durée qu’il précise et lui confère le droit d’exercer la profession de son choix dans les conditions prévues à l’article L. 414-10.
