Article R4311-40 of the French Public Health Code

A nurse who performs professional acts in France under the conditions provided for in article L. 4311-22 shall be subject to the disciplinary chamber of first instance in whose jurisdiction he or she performs the professional acts.

The National Council of the Order of Nurses shall receive the pleadings and documents produced by the parties. The National Council may submit observations in the number and within the time limit required in the notification. These are communicated to the parties.

In the event that several disciplinary chambers of first instance are simultaneously seised of complaints against the nurse providing services, the president of the national disciplinary chamber shall designate the disciplinary chamber of first instance which shall rule on the complaints.

L’infirmier ou l’infirmière qui exécute des actes professionnels en France dans les conditions prévues à l’article L. 4311-22 est soumis à la chambre disciplinaire de première instance dans le ressort duquel il exécute les actes professionnels.


Le Conseil national de l’ordre des infirmiers reçoit communication des mémoires et pièces produites par les parties. Le conseil national peut produire des observations dans les conditions de nombre et de délai requises dans la notification. Celles-ci sont communiquées aux parties.


Dans le cas où plusieurs chambres disciplinaires de première instance sont simultanément saisies de plaintes à l’égard de l’infirmier prestataire de services, le président de la chambre disciplinaire nationale désigne la chambre disciplinaire de première instance qui statue sur les plaintes.
