Article R4311-5-1 of the French Public Health Code

I.-The nurse may prescribe, under the conditions defined in article R. 4311-3, the vaccines mentioned in the order provided for by 1° of article L. 4311-1 to persons whose age conditions and, where applicable, pathologies are specified by this same order.

The nurse declares the activity of prescribing vaccines, by any means that provides a date certain on receipt of the declaration, to the competent authority of the council of the order of nurses on whose roll he or she is registered.

The declaration shall state the surname and first name of the nurse and his or her identification number in the sectoral reference register of natural persons referred to in article L. 1470-4.

If the nurse has not received training in prescribing vaccines as part of his or her initial training, the declaration must be accompanied by a training certificate issued by a training body or structure that complies with the educational objectives set by order of the Minister for Health, providing information in particular on the characteristics of vaccine-preventable diseases, the traceability of vaccinations and the main recommendations of the vaccination calendar.

Vaccine prescription activity may begin as soon as the declaration referred to in the second paragraph of this I has been received.

II – Nurses may administer, under the conditions defined in article R. 4311-3 :

1° The vaccines that he or she may prescribe in application of I ;

2° Without a prior medical prescription for the injection procedure, the vaccines mentioned in the order provided for by 2° of article L. 4311-1 to persons whose age conditions and, where applicable, pathologies are specified by this same order.

III -The nurse shall enter in the vaccinated person’s health record or vaccination record and shared medical record his or her surname and forename, the name of the vaccine administered, the date of administration and the batch number. If this information is not recorded, he will enter it in the nursing record and issue the vaccinated person with a vaccination certificate containing this information.

In the absence of a shared medical file and subject to the consent of the person vaccinated, the nurse will forward this information to the person’s GP. This information is transmitted via a secure health messaging system that meets the conditions laid down in article L. 1470-5, where such a system exists.

Article R4311-5-1

I.-L’infirmier ou l’infirmière peut prescrire, dans les conditions définies à l’article R. 4311-3, les vaccins mentionnés dans l’arrêté prévu par le 1° de l’article L. 4311-1 aux personnes dont les conditions d’âge et, le cas échéant, les pathologies sont précisées par ce même arrêté.

L’infirmier ou l’infirmière déclare l’activité de prescription de vaccins, par tout moyen donnant date certaine à la réception de la déclaration, auprès de l’autorité compétente du conseil de l’ordre des infirmiers au tableau duquel il ou elle est inscrit.

La déclaration mentionne les nom et prénom d’exercice et le numéro d’identification de l’infirmier ou l’infirmière au répertoire sectoriel de référence des personnes physiques mentionné à l’article L. 1470-4.

Lorsque l’infirmier ou l’infirmière n’a pas suivi d’enseignement relatif à la prescription de vaccins dans le cadre de sa formation initiale, la déclaration est accompagnée d’une attestation de formation délivrée par un organisme ou une structure de formation respectant les objectifs pédagogiques fixés par arrêté du ministre chargé de la santé, permettant de connaître notamment les caractéristiques des maladies à prévention vaccinale, la traçabilité des vaccinations et les principales recommandations du calendrier vaccinal.

L’activité de prescription de vaccins peut commencer dès la réception de la déclaration mentionnée au deuxième alinéa du présent I.

II.-L’infirmier ou l’infirmière peut administrer, dans les conditions définies à l’article R. 4311-3 :

1° Les vaccins qu’il ou elle peut prescrire en application du I ;

2° Sans prescription médicale préalable de l’acte d’injection, les vaccins mentionnés dans l’arrêté prévu par le 2° de l’article L. 4311-1 aux personnes dont les conditions d’âge et, le cas échéant, les pathologies sont précisées par ce même arrêté.

III.-L’infirmier ou l’infirmière inscrit dans le carnet de santé ou le carnet de vaccination et le dossier médical partagé de la personne vaccinée ses nom et prénom d’exercice, la dénomination du vaccin administré, la date de son administration et son numéro de lot. A défaut de cette inscription, il porte les mêmes informations dans le dossier de soins infirmiers et délivre à la personne vaccinée une attestation de vaccination qui comporte ces informations.

En l’absence de dossier médical partagé et sous réserve du consentement de la personne vaccinée, l’infirmier ou l’infirmière transmet ces informations au médecin traitant de cette personne. La transmission de cette information s’effectue par messagerie sécurisée de santé répondant aux conditions prévues à l’article L. 1470-5, lorsqu’elle existe.
