Article R4312-12 of the French Public Health Code

Once they have agreed to provide care, nurses are obliged to ensure continuity.

Nurses have the right to refuse care for professional or personal reasons, except in emergencies or in cases where they are failing in their duty of humanity.

If the nurse is obliged to interrupt or decides not to provide care, he or she must, provided that the patient is not harmed, explain the reasons, refer the patient to a colleague or a suitable structure and pass on the information needed to continue the care.

Dès lors qu’il a accepté d’effectuer des soins, l’infirmier est tenu d’en assurer la continuité.


Hors le cas d’urgence et celui où il manquerait à ses devoirs d’humanité, un infirmier a le droit de refuser ses soins pour une raison professionnelle ou personnelle.


Si l’infirmier se trouve dans l’obligation d’interrompre ou décide de ne pas effectuer des soins, il doit, sous réserve de ne pas nuire au patient, lui en expliquer les raisons, l’orienter vers un confrère ou une structure adaptée et transmettre les informations utiles à la poursuite des soins.
