Article R4312-43 of the French Public Health Code

The nurse applies and complies with the protocols drawn up by the doctor in accordance with the provisions of articles R. 4311-7 and R. 4311-14.

Whenever they consider it essential, nurses ask the doctor in charge to draw up a written, dated and signed protocol.

In the event of the implementation of a written protocol of emergency care, or of protective acts performed until the intervention of a doctor, the nurse will provide the latter with a written, dated and signed report, which will be appended to the patient’s file.

In the event of an emergency, and unless a protocol has been implemented, the nurse decides what action to take until a doctor can intervene. They take all measures within their power to direct the patient to the most appropriate care structure for their condition.

L’infirmier applique et respecte les protocoles élaborés par le médecin prévus par les dispositions des articles R. 4311-7 et R. 4311-14.


Chaque fois qu’il l’estime indispensable, l’infirmier demande au médecin responsable d’établir un protocole écrit, daté et signé.


En cas de mise en œuvre d’un protocole écrit de soins d’urgence, ou d’actes conservatoires accomplis jusqu’à l’intervention d’un médecin, l’infirmier remet à ce dernier un compte rendu écrit, daté et signé, et annexé au dossier du patient.


En cas d’urgence et en dehors de la mise en œuvre d’un protocole, l’infirmier décide des gestes à pratiquer en attendant que puisse intervenir un médecin. Il prend toute mesure en son pouvoir afin de diriger la personne vers la structure de soins la plus appropriée à son état.
