Article R4312-58 of the French Public Health Code

Before undertaking any expert assessment operation, the expert nurse informs the person he is to examine of his mission and the legal framework in which his opinion is sought.

The expert nurse is obliged to respect the adversarial principle throughout the expert assessment operations.

In drafting his report, the expert nurse must only reveal information that is likely to provide an answer to the questions asked. Outside these limits, he must not reveal anything that he may have learnt in the course of the assessment.

He certifies that he has personally carried out his mission.

Avant d’entreprendre toute opération d’expertise, l’infirmier expert informe la personne qu’il doit examiner de sa mission et du cadre juridique dans lequel son avis est demandé.


L’infirmier expert est tenu de respecter le principe du contradictoire pendant la totalité des opérations d’expertise.


Dans la rédaction de son rapport, l’infirmier expert ne doit révéler que les éléments de nature à apporter une réponse aux questions posées. Hors ces limites, il doit taire tout ce qu’il a pu connaître à l’occasion de cette expertise.


Il atteste qu’il a accompli personnellement sa mission.
