Once he has completed his assignment and ensured continuity of care, the replacement nurse gives up all his replacement activities with the clientele of the replaced nurse.

A nurse who replaces one of his colleagues for a period of more than three months, consecutive or otherwise, must not, for a period of two years, set up in a practice where he may enter into direct competition with the colleague replaced and, where applicable, with nurses practising in association or partnership with the latter, unless there is an agreement between the parties concerned, which must be notified to the Conseil Départemental de l’Ordre. If such an agreement cannot be reached, the matter must be submitted to the aforementioned council, which will assess the appropriateness of the move and decide on the installation.

Lorsqu’il a terminé sa mission et assuré la continuité des soins, l’infirmier remplaçant abandonne l’ensemble de ses activités de remplacement auprès de la clientèle de l’infirmier remplacé.

L’infirmier qui remplace un de ses collègues pendant une période supérieure à trois mois, consécutifs ou non, ne doit pas, pendant une période de deux ans, s’installer dans un cabinet où il puisse entrer en concurrence directe avec le confrère remplacé et, éventuellement, avec les infirmiers exerçant en association ou en société avec celui-ci, à moins qu’il n’y ait entre les intéressés un accord, lequel doit être notifié au conseil départemental de l’ordre. Lorsqu’un tel accord n’a pu être obtenu, l’affaire doit être soumise audit conseil qui apprécie l’opportunité et décide de l’installation.
