Article R4313-16 of the French Labour Code

The person responsible for hiring out or repeatedly making available second-hand personal protective equipment shall ensure that this equipment is maintained in a state of compliance by following, in particular, the instructions provided for in a of I of paragraph 1.4 of Annex II which appear at the end of this Title and by carrying out, where applicable, the periodic general inspections provided for in Article R. 4323-99.

An order by the ministers responsible for labour or agriculture specifies the information available to the person responsible for the operations provided for in this article in order to establish that the personal protective equipment is maintained in compliance. He shall provide this information at the request of the user of the personal protective equipment or the supervisory authorities.

Le responsable de la location ou de la mise à disposition réitérée d’un équipement de protection individuelle d’occasion s’assure du maintien en état de conformité de cet équipement en suivant, notamment, les instructions prévues au a du I du paragraphe 1. 4 de l’annexe II qui figurent à la fin du présent titre et en procédant, le cas échéant, aux vérifications générales périodiques prévues à l’article R. 4323-99.


Un arrêté des ministres chargés du travail ou de l’agriculture précise les éléments dont le responsable des opérations prévues au présent article dispose afin d’établir le maintien en conformité de l’équipement de protection individuelle. Il communique ces éléments sur demande du preneur de l’équipement de protection individuelle ou des autorités de contrôle.
