Article R4313-58 of the French Labour Code

For each model of personal protective equipment manufactured, a notified body chosen by the manufacturer shall take an adequate sample of the personal protective equipment at random intervals, at least once a year. Under its responsibility, it shall examine the sample and perform the appropriate tests defined by the standards referred to in 6° of Article L. 4311-7 or necessary to ensure that the samples of personal protective equipment comply with the technical rules applicable to them.The notified body, if it is not the body which issued the EC type-examination certificate, shall contact the latter in the event of difficulty in assessing the conformity of the personal protective equipment taken from the sample. The notified body shall send the manufacturer an expert report within two months of the expert assessment.

Pour chaque modèle d’équipement de protection individuelle fabriqué, un organisme notifié choisi par le fabricant prélève un échantillonnage adéquat de l’équipement de protection individuelle à des intervalles aléatoires, au moins une fois par an. Sous sa responsabilité, il l’examine et réalise sur cet échantillonnage les essais appropriés définis par les normes mentionnées au 6° de l’article L. 4311-7 ou nécessaires pour s’assurer de la conformité des échantillons d’équipement de protection individuelle avec les règles techniques qui leur sont applicables.L’organisme notifié, s’il n’est pas celui qui a délivré l’attestation d’examen CE de type, prend contact avec ce dernier en cas de difficulté pour apprécier la conformité des équipements de protection individuelle prélevés dans l’échantillonnage.L’organisme notifié adresse au fabricant un rapport d’expertise dans un délai de deux mois suivant celle-ci.
