Article R4313-59 of the French Labour Code

Where the report provided for in Article R. 4313-58 concludes that there is a lack of homogeneity of production or that the samples of personal protective equipment examined do not conform to the model described in the EC type-examination certificate and the applicable technical rules, the notified body shall take the appropriate measures in the light of the defects found and shall inform the Minister responsible for labour. The period within which the expert report is sent to the manufacturer is reduced to the time strictly necessary for the drafting and transmission of this report.

Lorsque le rapport prévu par l’article R. 4313-58 conclut à une absence d’homogénéité de la production ou à l’absence de conformité des échantillons d’équipement de protection individuelle examinés avec le modèle décrit dans l’attestation d’examen CE de type et les règles techniques applicables, l’organisme notifié prend les mesures qui s’imposent en fonction des défauts constatés et en informe le ministre chargé du travail. Le délai dans lequel le rapport d’expertise est adressé au fabricant est réduit au temps strictement nécessaire pour la rédaction et la transmission de ce rapport.
