Article R4314-15 of the French Labour Code

In the event of non-conformity of equipment established by checks carried out by the market surveillance authority, the costs which may be charged to the economic operator in question on the basis of the third paragraph of Article L. 4314-1 include the costs of acquisition, packaging, transport, documentary checks, testing, analysis, physical checks, trials, expert appraisals and storage costs incurred by the authority in establishing this non-conformity.

Where a market surveillance authority intends to ask the economic operator concerned to recover the costs referred to in the previous paragraph, it shall notify it of the amount of recovery envisaged and invite it to submit its observations within a period of one month.

On expiry of this period and in the light of any comments from the interested party, it will notify its decision and issue the corresponding collection order.

En cas de non-conformité d’un équipement établie par les contrôles effectués par l’autorité de surveillance du marché, les coûts qui peuvent être mis à la charge de l’opérateur économique en cause sur le fondement du troisième alinéa de l’article L. 4314-1 comprennent les frais d’acquisition, de conditionnement, de transport, de contrôle documentaire, de test, d’analyse, de contrôle physique, d’essai, d’expertise et le coût de stockage que l’autorité a exposés pour établir cette non-conformité.

Lorsqu’une autorité de surveillance du marché envisage de demander à l’opérateur économique concerné le recouvrement des frais mentionnés au précédent alinéa, elle lui communique le montant du recouvrement envisagé et l’invite à présenter ses observations dans un délai d’un mois.

A l’expiration de ce délai et au regard des observations éventuelles de l’intéressé, elle notifie sa décision et émet le titre de perception correspondant.
