Article R434-23 of the French Code governing the entry and residence of foreign nationals and the right of asylum

On completion of the checks on the family reunification applicant’s resources and accommodation, the mayor of the municipality where the family is to reside will forward the file to the Office français de l’immigration et de l’intégration, together with the results of these checks and his reasoned opinion. If there is no response from the mayor within two months of the dossier being sent, this opinion is deemed to be favourable.

A l’issue des vérifications sur les ressources et le logement du demandeur du regroupement familial, le maire de la commune où doit résider la famille transmet à l’Office français de l’immigration et de l’intégration le dossier accompagné des résultats de ces vérifications et de son avis motivé. En l’absence de réponse du maire à l’expiration d’un délai de deux mois à compter de la communication du dossier, cet avis est réputé favorable.
