Article R4362-9 of the French Public Health Code

The commission is composed of

1° A representative of the Minister for Health, Chairman ;

2° A representative of the Minister for Higher Education;

3° A representative of the Minister for Trade and Craft Trades;

4° A doctor specialising in ophthalmology, appointed and his or her alternate by order of the Minister for Health, on the recommendation of the opticians’ commission of the Higher Council for the Paramedical Professions;

5° Four retail opticians appointed and their alternates by order of the Minister for Health, on the recommendation of the opticians’ commission of the Conseil supérieur des professions paramédicales.

The commission may only sit if the majority of its members are present and decides by a majority of the votes of the members present. In the event of a tie, the chairman will have the casting vote.

Article R4362-9

La commission est ainsi composée :

1° Un représentant du ministre chargé de la santé, président ;

2° Un représentant du ministre chargé de l’enseignement supérieur ;

3° Un représentant du ministre chargé du commerce et de l’artisanat ;

4° Un médecin spécialiste en ophtalmologie nommé ainsi que son suppléant par arrêté du ministre chargé de la santé, sur proposition de la commission des opticiens-lunetiers du Conseil supérieur des professions paramédicales ;

5° Quatre opticiens-lunetiers détaillants nommés ainsi que leurs suppléants par arrêté du ministre chargé de la santé, sur proposition de la commission des opticiens-lunetiers du Conseil supérieur des professions paramédicales.

La commission ne peut siéger que si la majorité de ses membres est présente et se prononce à la majorité des voix des membres présents. En cas de partage égal des voix, celle du président est prépondérante.
