Article R441-6 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Foreign nationals applying for the visa provided for in article L. 441-7 must present their travel document, the document authorising them to stay in Mayotte, documents establishing the conditions of their stay in the département of destination, the means of subsistence enabling them to meet their living expenses and guarantees of their return to Mayotte.
Except in exceptional circumstances, this visa may be issued for a stay of more than three months.
Save in exceptional circumstances, this visa may not be issued for a stay exceeding three months.
The State representative in Mayotte obtains the opinion of the Prefect of the département of destination. This opinion is deemed to be favourable if the prefect consulted has not made any objections known within fifteen days.

L’étranger qui sollicite le visa prévu à l’article L. 441-7 présente son document de voyage, le titre sous couvert duquel il est autorisé à séjourner à Mayotte, les documents permettant d’établir les conditions de son séjour dans le département de destination, les moyens d’existence lui permettant de faire face à ses frais de séjour ainsi que les garanties de son retour à Mayotte.
Sauf circonstances exceptionnelles, ce visa ne peut lui être délivré pour une durée de séjour excédant trois mois.
Le représentant de l’Etat à Mayotte recueille l’avis du préfet du département de destination. Cet avis est réputé favorable si le préfet consulté n’a pas fait connaître d’opposition dans le délai de quinze jours.
