Article R444-42 of the French Commercial code

The provisions of this Title apply to judicial auctioneers and other public or ministerial officers selling movable property, with the exception of those of paragraph 1 of sub-section 1 of section 2 as regards notaries and bailiffs who perform these functions pursuant to 3° of the article 1 of the law of 1 June 1924 introducing French commercial laws into the departments of Bas-Rhin, Haut-Rhin and Moselle.

Les dispositions du présent titre s’appliquent aux commissaires-priseurs judiciaires ainsi qu’aux autres officiers publics ou ministériels vendeurs de meubles, à l’exception de celles du paragraphe 1 de la sous-section 1 de la section 2 en ce qui concerne les notaires et huissiers de justice qui exercent ces fonctions en application du 3° de l’article 1er de la loi du 1er juin 1924 portant introduction des lois commerciales françaises dans les départements du Bas-Rhin, du Haut-Rhin et de la Moselle.
