Article R444-49 of the French Commercial code

Where, pursuant to the second paragraph of article 16 of decree no. 56-222 of 29 February 1956, a bailiff entrusts the service of a document to a colleague, the corresponding emolument is paid to the bailiff initially seized, then shared with the serving bailiff. The rules for sharing fees, excluding rebates, are as follows:

1° The bailiff who drafts the document receives one third of the emolument for the service;

2° The bailiff who signs the document receives two thirds of the emolument for the service, as well as the full reimbursement of travel expenses.

The respective discount granted by each participant is, where applicable, deducted from the share to which he is entitled pursuant to the first paragraph.

Article R444-49

Lorsque, en application du second alinéa de l’article 16 du décret n° 56-222 du 29 février 1956, un huissier de justice confie la signification d’un acte à un confrère, l’émolument correspondant est versé à l’huissier initialement saisi, puis partagé avec l’huissier significateur. Les règles de partage des émoluments, hors remises, sont les suivantes :

1° L’huissier de justice rédacteur de l’acte perçoit un tiers de l’émolument de la prestation ;

2° L’huissier de justice significateur perçoit deux tiers de l’émolument de la prestation, ainsi que la totalité du remboursement des frais de déplacement.

La remise respectivement consentie par chaque intervenant est, le cas échéant, déduite de la part lui revenant en application du premier alinéa.
