Article R4451-126 of the French Labour Code

A joint order of the ministers responsible for labour, radiation protection and agriculture shall determine:

1° With regard to the competent person in charge of radiation protection:

a) The content and duration of training in radiation protection for the public, workers and the environment, taking into account the nature of the activity carried out and the characteristics of the ionising radiation sources used;

b) The qualifications, skills and experience of the persons responsible for training;

c) The procedures for testing knowledge;

d) The conditions for issuing and renewing the training certificate;

e) The period of validity of the training certificate;

f) The procedures and conditions for certifying training bodies;

g) The procedures and conditions for accrediting certifying bodies;

2° With regard to the competent radiation protection body:

a) The qualifications, skills and professional experience of the persons working within this body as radiation protection advisors in client establishments;

b) The organisational requirements, in particular to ensure the confidentiality of data relating to individual dosimetric monitoring;

c) The terms and conditions of certification of these bodies;

d) The terms and conditions of accreditation of the certifying bodies;

3° Concerning the centre of expertise in radiation protection:

a) The qualifications, skills and professional experience of the people making it up;

b) The organisational requirements, in particular to ensure the confidentiality of data relating to individual dosimetric monitoring;

c) The terms and conditions for approval of the radiation protection competence centres by the competent authorities mentioned in 3° of Article R. 4451-125 ;

d) The organisational requirements and resources necessary for the independent and objective performance of the tasks provided for in Article R. 4451-123 and the initial verification tasks provided for in Articles R. 4451-40 and R. 4451-44.

Article R4451-126

Un arrêté conjoint des ministres chargés du travail, de la radioprotection et de l’agriculture détermine :

1° Pour ce qui concerne la personne compétente en radioprotection :

a) Le contenu et la durée de la formation à la radioprotection du public, des travailleurs et de l’environnement, en tenant compte de la nature de l’activité exercée, des caractéristiques des sources de rayonnements ionisants utilisés ;

b) La qualification, la compétence et l’expérience des personnes chargées de la formation ;

c) Les modalités de contrôle des connaissances ;

d) Les conditions de délivrance et de renouvellement du certificat de formation ;

e) La durée de validité du certificat de formation ;

f) Les modalités et conditions de certification des organismes de formation ;

g) Les modalités et conditions d’accréditation des organismes certificateurs ;

2° Pour ce qui concerne l’organisme compétent en radioprotection :

a) La qualification, la compétence et l’expérience professionnelle des personnes assurant au sein de cet organisme les fonctions de conseiller en radioprotection dans les établissements clients ;

b) Les exigences organisationnelles, notamment permettant d’assurer la confidentialité des données relatives à la surveillance dosimétrique individuelle ;

c) Les modalités et conditions de certification de ces organismes ;

d) Les modalités et conditions d’accréditation des organismes certificateurs ;

3° Pour ce qui concerne le pôle de compétences en radioprotection :

a) La qualification, les compétences et l’expérience professionnelle des personnes le constituant ;

b) Les exigences organisationnelles, notamment permettant d’assurer la confidentialité des données relatives à la surveillance dosimétrique individuelle ;

c) Les modalités et conditions d’approbation des pôles de compétences en radioprotection par les autorités compétentes mentionnées au 3° de l’article R. 4451-125 ;

d) Les exigences organisationnelles et de moyens nécessaires à l’exercice indépendant et objectif des missions prévues à l’article R. 4451-123 de celles de vérification initiale prévues aux articles R. 4451-40 et R. 4451-44.
