Article R4461-33 of the French Labour Code

In order to issue the authorisation referred to in 1° of Article R. 4461-29, the competent administrative authority shall ensure in particular that the organisational procedures and conditions meet the requirements laid down by the orders referred to in Article R. 4461-30.

Where the organisational procedures and conditions no longer meet the requirements laid down by the orders referred to in Article R. 4461-30, the competent administrative authority shall withdraw the authorisation issued.

Withdrawal is made by a reasoned decision after the expiry of a period of thirty days following the notification of a formal notice to the holder of the authorisation specifying the complaints made against him.

Pour délivrer l’habilitation mentionnée au 1° de l’article R. 4461-29, l’autorité administrative compétente s’assure en particulier que les modalités et conditions d’organisation répondent aux exigences fixées par les arrêtés mentionnés à l’article R. 4461-30.


Lorsque les modalités et conditions d’organisation ne répondent plus aux exigences fixées par les arrêtés mentionnés à l’article R. 4461-30, l’autorité administrative compétente retire l’habilitation délivrée.


Le retrait est prononcé par décision motivée après l’expiration d’un délai de trente jours suivant la notification d’une mise en demeure au titulaire de l’habilitation précisant les griefs formulés à son encontre.
