Article R4535-2 of the French Labour Code

Self-employed workers and employers, when working directly on a building or civil engineering site, are only subject to the provisions of article R. 4534-18 concerning the examination of equipment, machinery, installations or protective devices on sites subject to the obligation to coordinate the safety and health of workers referred to in article L. 4532-2, with the exception of operations undertaken by a private individual for his own personal use as referred to in 2° of article L. 4532-7.

Similarly, compliance with the provisions of the first and second paragraphs of Article R. 4534-86 and those of Article R. 4534-99 is not compulsory for these workers, provided that they actually use a fall arrest system.

Article R4535-2

Les travailleurs indépendants ainsi que les employeurs, lorsqu’ils exercent directement une activité sur un chantier de bâtiment et de génie civil, ne sont soumis aux dispositions prévues en matière d’examen du matériel, des engins, installations ou dispositifs de protection par l’article R. 4534-18 que sur les chantiers soumis à obligation de coordination en matière de sécurité et de santé des travailleurs mentionnés à l’article L. 4532-2, à l’exception des opérations entreprises par un particulier pour son usage personnel mentionné au 2° de l’article L. 4532-7.

De même, le respect des dispositions des premier et deuxième alinéas de l’article R. 4534-86 et celles de l’article R. 4534-99 n’est pas obligatoire pour ces travailleurs, sous réserve qu’ils utilisent effectivement un système d’arrêt de chute.
