Article R4543-16 of the French Labour Code

When organising the work referred to in article R. 4543-15, the head of the company carrying out the work defines the operating procedures appropriate to the technology of the equipment and its environment.

This organisation takes into account:

1° The consequences of the introduction of new technologies;

2° The conclusions drawn from experience gained and the analysis of accidents at work;

3° The training and professional qualifications of the personnel with regard to the aptitude required to carry out the work.

Lors de l’organisation des interventions ou travaux mentionnés à l’article R. 4543-15, le chef de l’entreprise intervenante définit les modes opératoires appropriés à la technologie de l’équipement et à son environnement.

Cette organisation prend en compte :

1° Les conséquences de l’introduction de nouvelles technologies ;

2° Les conclusions tirées de l’expérience acquise et de l’analyse des accidents du travail ;

3° Les formations et les qualifications professionnelles des personnels au regard de l’aptitude nécessaire à la réalisation des interventions ou travaux.
