When the AMF informs the Financial Public Prosecutor of its intention to issue a statement of objections pursuant to the first paragraph of III of Article L. 465-3-6, it shall send the Financial Public Prosecutor, by registered letter with acknowledgement of receipt or by delivery against receipt, the factual and legal information on which the proposed statement of objections is based.
Within the period stipulated in the first paragraph of III of Article L. 465-3-6, the Financial Public Prosecutor shall inform the AMF of its intention to initiate or not initiate public proceedings by registered letter with acknowledgement of receipt or by letter delivered against receipt.
When the Autorité des marchés financiers confirms its intention to issue a statement of complaint pursuant to the third paragraph of III of Article L. 465-3-6, it shall refer the matter to the Public Prosecutor at the Paris Court of Appeal by registered letter with acknowledgement of receipt or by letter delivered against receipt, enclosing the letters provided for in the first two paragraphs. It shall inform the Financial Public Prosecutor in the same way.
