Article R49-10 of the French Code of Criminal Procedure

A notice of fine and a payment card, the model for which is set by order of the Minister of Justice, shall be given to the offender when one of the offences provided for in article R. 49-8-5.

The notice mentions the amount of the reduced fixed fine, the time allowed to pay it and the person or service with whom payment must be made.

It also mentions the procedure applicable in the event of non-payment of the fixed fine, in particular the time limit and procedures for the request provided for in the first paragraph of article 529-2, the amount of the fixed fine that the offender must pay as well as the amount of the increased fixed fine that will be payable by the offender in the event of non-payment of the fixed fine or failure to submit a request within the time limit.

When the documents mentioned in the previous paragraphs cannot be given to the offender, they are sent to the holder of the registration certificate.

The provisions of the third paragraph of I and those of II of Article R. 49-1 are applicable.

Un avis de contravention et une carte de paiement, dont le modèle est fixé par arrêté du garde des sceaux, ministre de la justice, sont remis au contrevenant au moment de la constatation de l’une des infractions prévues par l’article R. 49-8-5.

L’avis mentionne le montant de l’amende forfaitaire minorée, le délai accordé pour la régler, la personne ou le service auprès duquel le paiement doit être effectué.

Il mentionne également la procédure applicable en cas de non-paiement de l’amende forfaitaire minorée, notamment le délai et les modalités de la requête prévue par le premier alinéa de l’article 529-2, le montant de l’amende forfaitaire dont le contrevenant doit s’acquitter ainsi que le montant de l’amende forfaitaire majorée qui sera due par le contrevenant en cas de non-paiement de l’amende forfaitaire ou à défaut de la présentation d’une requête dans les délais.

Lorsque les documents mentionnés aux alinéas précédents ne peuvent être remis au contrevenant, ils sont adressés au titulaire du certificat d’immatriculation.

Les dispositions du troisième alinéa du I et celles du II de l’article R. 49-1 sont applicables.
