The person concerned, of French nationality and residing abroad, who is unable to fulfil the obligations resulting from article 706-25-7 because of the absence of French representation in the foreign country where they reside or the absence of a consular section in the embassy or consulate closest to their place of residence, may request authorisation from the public prosecutor or investigating judge who carried out their registration, to send their supporting documents by post with acknowledgement of receipt to the file manager.
The public prosecutor or examining magistrate may also decide to do this on their own initiative.
If they grant this request, they will inform the person concerned and the management department.
In the event of refusal, the person concerned may appeal against this decision in accordance with the terms of articles R. 50-56 et seq.
Any request must be made, on pain of inadmissibility, by registered letter with acknowledgement of receipt, or by declaration to the court registry.
The list of countries without French representation and posts without a consular section shall be communicated, and updated as necessary, by the Minister of Foreign Affairs and International Development to the manager of the file referred to in Article R. 50-37.
