Article R511-25 of the French Monetary and Financial Code

The deferred instruments referred to in Article L. 511-79 are equity instruments, debt instruments or other instruments referred to in Article L. 511-81.

Credit institutions and finance companies update the variable remuneration mentioned in article L. 511-79 according to the inflation rate and the risk incurred, which includes the duration of the deferment period. An order of the Minister for the Economy specifies the methods for calculating the discount rate.

Les instruments différés mentionnés à l’article L. 511-79 s’entendent des instruments de capitaux propres, de dettes ou des autres instruments mentionnés à l’article L. 511-81.

Les établissements de crédit et les sociétés de financement actualisent la part de rémunération variable mentionnée à l’article L. 511-79 en fonction notamment du taux d’inflation et du risque encouru, qui comprend la durée de la période de différé. Un arrêté du ministre chargé de l’économie précise les modalités de calcul du taux d’actualisation.
