Article R512-11 of the French Intellectual Property Code

Where the filing has been made in simplified form, the applicant must, no later than six months before the end of the three-year period provided for in Article R. 512-10, waive deferment of publication in writing and deliver to the National Institute of Industrial Property:

1° Graphic or photographic reproductions of the design(s) to be published that comply with the presentation requirements set out in 2° of Article R. 512-3;

2° Proof of payment of the prescribed royalties.

Failing this, the total or partial forfeiture of the rights arising from the filing shall be recorded by the Director General of the Institut national de la propriété industrielle.

In the event that the graphic or photographic reproductions do not comply with the terms of Article R. 512-3 or where the reproduction supplied when the deferment is waived does not correspond identically to one of the representations attached to the simplified filing, the procedure provided for in Article R. 512-9.

Lorsque le dépôt a été effectué sous forme simplifiée, le déposant doit, au plus tard six mois avant le terme du délai de trois ans prévu à l’article R. 512-10, renoncer par écrit à l’ajournement de la publication et remettre à l’Institut national de la propriété industrielle :

1° Les reproductions graphiques ou photographiques du ou des dessins ou modèles à publier conformes aux exigences de présentation prévues au 2° de l’article R. 512-3 ;

2° La justification du paiement des redevances prescrites.

A défaut, la déchéance totale ou partielle des droits issus du dépôt est constatée par le directeur général de l’Institut national de la propriété industrielle.

En cas de non-conformité des reproductions graphiques ou photographiques aux modalités de l’article R. 512-3 ou lorsque la reproduction fournie lors de la renonciation à l’ajournement ne correspond pas à l’identique à l’une des représentations jointes au dépôt simplifié, il est fait application de la procédure prévue à l’article R. 512-9.
