Article R512-15 of the French Intellectual Property Code

Acts modifying the ownership of a design deposit or the enjoyment of the rights attached thereto, such as assignment, grant of a right of exploitation, constitution or assignment of a right of pledge or renunciation of such right, seizure, validation and release of seizure, shall be registered at the request of one of the parties to the act, or, if he is not a party to the act, of the owner of the deposit on the day of such request.

However, a deed may only be registered if the person indicated in the deed as the holder of the design registration prior to the amendment resulting from the deed is registered as such in the National Designs Register.

The application shall include:

1° A registration application form;

2° A copy or extract of the deed recording the change in ownership or enjoyment;

3° Proof of payment of the prescribed fee;

4° If applicable, the power of attorney of the agent, unless he is an industrial property attorney or a lawyer.

Article R512-15

Les actes modifiant la propriété d’un dépôt de dessin ou modèle ou la jouissance des droits qui lui sont attachés, tels que cession, concession d’un droit d’exploitation, constitution ou cession d’un droit de gage ou renonciation à ce droit, saisie, validation et mainlevée de saisie, sont inscrits à la demande de l’une des parties à l’acte, ou, s’il n’est pas partie à l’acte, du titulaire du dépôt au jour de cette demande.

Toutefois, un acte ne peut être inscrit que si la personne indiquée dans l’acte comme le titulaire du dépôt de dessin et modèle avant la modification résultant de l’acte est inscrite comme telle au Registre national des dessins et modèles.

La demande comprend :

1° Un bordereau de demande d’inscription ;

2° Une copie ou un extrait de l’acte constatant la modification de la propriété ou de la jouissance ;

3° La justification du paiement de la redevance prescrite ;

4° S’il y a lieu, le pouvoir du mandataire, à moins qu’il n’ait la qualité de conseil en propriété industrielle ou d’avocat.
