Article R512-17 of the French Intellectual Property Code

Changes of name, legal form, address and corrections of material errors are recorded at the request of the owner of the filing, who must be the owner entered in the National Designs Register. However, where such changes and rectifications relate to an act previously recorded, the request may be made by any party to the act.

The request shall include:

1° A registration request form;

2° If applicable, the power of attorney of the representative, unless he is an industrial property attorney or a lawyer;

3° If it concerns a rectification of a material error, proof of payment of the prescribed fee.

The Institute may require proof of the reality of the change for which registration is requested or of the material error to be rectified.

Les changements de nom, de forme juridique, d’adresse et les rectifications d’erreurs matérielles sont inscrits à la demande du titulaire du dépôt, qui doit être le titulaire inscrit au Registre national des dessins et modèles. Toutefois, lorsque ces changements et rectifications portent sur un acte précédemment inscrit, la demande peut être présentée par toute partie à l’acte.

La demande comprend :

1° Un bordereau de demande d’inscription ;

2° S’il y a lieu, le pouvoir du mandataire, à moins qu’il n’ait la qualité de conseil en propriété industrielle ou d’avocat ;

3° S’il s’agit d’une rectification d’erreur matérielle, la justification du paiement de la redevance prescrite.

L’institut peut exiger la justification de la réalité du changement dont l’inscription est sollicitée ou de l’erreur matérielle à rectifier.
