I.- Articles R. 5121-133 to R. 5121-135 do not apply to gene therapy and xenogenic cell therapy preparations.
II-Any gene therapy or xenogenic cell therapy preparation that does not have the authorisation mentioned in 12° or 13° of Article L. 5121-1 is subject to an export authorisation issued by the Director General of the Agence nationale de sécurité du médicament et des produits de santé.
III – The application for an export authorisation must be made by any means capable of providing a date certain. It indicates :
1° The name and address of the establishment or body authorised under Articles L. 4211-8 or L. 4211-9;
2° The recipient country and establishment;
3° The name, composition, pharmaceutical form, strength and route of administration of the product;
4° The quantities exported;
5° The purpose of the export.
An export authorisation is required for each export operation.
