Article R5121-33 of the French Public Health Code

The experts referred to in Article L. 5121-20 shall have the following qualifications and experience, as set out in a summary of the curriculum vitae attached to the marketing authorisation application file:

1° For the pharmaceutical expert: a qualification in pharmacy attested by a State or university diploma in pharmacy, or, for medicinal products derived from biotechnology, a specific qualification attested by a diploma, and sufficient practical experience either in research and development, or in manufacturing, or in the physical, chemical, physico-chemical, biological or microbiological testing of medicinal products;

2° For the expert toxicologist: a qualification in general or specialised toxicology attested by a diploma and sufficient practical experience;

3° For the expert pharmacologist: a general or specialised qualification attested by a diploma and sufficient practical experience;

4° For the clinical expert: a qualification attested by a medical diploma and sufficient practical clinical and statistical experience.

They must have the appropriate resources to carry out their expert appraisal work, be of good repute and have no direct or indirect financial interest, even through intermediaries, in the marketing of the medicinal products which are the subject of their expert appraisals.

Les experts mentionnés à l’article L. 5121-20 disposent des qualifications et de l’expérience suivantes, énoncées dans un résumé du curriculum vitae joint au dossier de demande d’autorisation de mise sur le marché :

1° Pour l’expert pharmaceutique : une qualification en pharmacie attestée par un diplôme d’Etat ou d’université de pharmacien, ou, pour les médicaments issus de la biotechnologie, une qualification particulière attestée par un diplôme, et une expérience pratique suffisante soit dans la recherche et le développement, soit dans la fabrication, soit dans les contrôles physiques, chimiques, physico-chimiques, biologiques ou microbiologiques des médicaments ;

2° Pour l’expert toxicologue : une qualification en toxicologie générale ou spécialisée attestée par un diplôme et une expérience pratique suffisante ;

3° Pour l’expert pharmacologue : une qualification générale ou spécialisée attestée par un diplôme et une expérience pratique suffisante ;

4° Pour l’expert clinicien : une qualification attestée par un diplôme de médecin et une expérience pratique clinique et statistique suffisante.

Ils disposent des moyens propres à l’accomplissement des travaux d’expertise, présentent les garanties d’honorabilité nécessaires et n’ont aucun intérêt financier direct ou indirect même par personnes interposées dans la commercialisation des médicaments faisant l’objet de leurs expertises.
