Classification in the category of medicinal products reserved for hospital use has the following effects:
1° Prescription of the medicinal product is reserved :
a) To a doctor, dental surgeon or midwife meeting the conditions laid down in Book I of Part IV of this Code, as well as in I of Article 60 of Law no. 99-641 of 27 July 1999 creating universal health cover, and practising in a public or private health establishment or in a health cooperation grouping authorised, respectively, under Articles L. 6132-2, as it stood prior to the publication of law no. 2009-879 of 21 July 2009 on hospital reform and patients, health and the territories, and L. 6133-7, to carry out the tasks of a health establishment ;
b) A doctor meeting the same conditions, strictly within the framework of the activity he or she carries out in an authorised cosmetic surgery facility;
c) In public health establishments, to any other person authorised to prescribe, acting under the responsibility of a department manager or, by delegation of the latter, a manager of an internal structure of the department, with the exception of functional units;
2° The dispensing of the medicinal product is reserved for the in-house pharmacies of the establishments mentioned in 1° or for those of the health cooperation groups acting on behalf of the health establishments which are members of them or, where applicable, for the persons carrying out, in these establishments, the responsibilities mentioned in article L. 5126-6;
3° The medicinal product may only be administered as part of hospitalisation or care in a hospital environment within an establishment listed in 1° or at the patient’s home as part of a home hospitalisation or home dialysis activity. However, the marketing authorisation may expressly state that the medicinal product may only be administered during hospitalisation in an establishment listed in 1°.
