Article R5124-13 of the French Public Health Code

Any change in the holder of an authorisation to open a pharmaceutical establishment is subject to prior authorisation. However, the Director General of the Agence nationale de sécurité du médicament et des produits de santé may, at the joint request of the two pharmacists in charge concerned, authorise the transfer of the initial opening authorisation.

If the establishment is leased under management, the lessee-manager must apply under the same conditions to change the holder of the authorisation to open, or where appropriate, to transfer it for the duration of the management lease.

The transfer is approved by the Chief Executive Officer of the agency, subject to compliance with the provisions of this chapter by the new owner or the lessee-manager.

Le changement de titulaire d’une autorisation d’ouverture d’établissement pharmaceutique est soumis à une autorisation préalable. Toutefois, le directeur général de l’Agence nationale de sécurité du médicament et des produits de santé peut autoriser, sur demande conjointe des deux pharmaciens responsables concernés, le transfert de l’autorisation initiale d’ouverture.

En cas de mise en location-gérance de l’établissement, le locataire-gérant demande dans les mêmes conditions, le changement de titulaire de l’autorisation d’ouverture, ou le cas échéant, son transfert pour la durée de la location-gérance.

Le transfert est prononcé par le directeur général de l’agence sous réserve du respect des dispositions du présent chapitre par le nouveau propriétaire ou le locataire-gérant.
