Article R5124-28-1 of the French Public Health Code

In pharmaceutical establishments created within public establishments and non-profit organisations in application of article L. 5124-9-1, the legal representative of the legal entity concerned appoints, at the same time as the pharmacist in charge, one or more interim pharmacists in charge.

When an establishment or organisation manufactures advanced therapy medicinal products in several establishments, the legal representative of the legal entity concerned appoints a delegate pharmacist and one or more interim delegate pharmacists who carry out their duties under the authority of the responsible pharmacist.

Within the Etablissement Français du Sang, the responsible pharmacist has authority over the directors of the blood transfusion establishments for the performance of this task.

Dans les établissements pharmaceutiques créés au sein des établissements publics et des organismes à but non lucratif en application de l’article L. 5124-9-1, le représentant légal de la personne morale concernée désigne, en même temps que le pharmacien responsable, un ou plusieurs pharmaciens responsables intérimaires.


Lorsqu’un établissement ou un organisme fabrique des médicaments de thérapie innovante dans plusieurs établissements, le représentant légal de la personne morale concernée désigne un pharmacien délégué ainsi qu’un ou plusieurs pharmaciens délégués intérimaires qui exercent leur mission sous l’autorité du pharmacien responsable.


Au sein de l’Etablissement français du sang, le pharmacien responsable a autorité sur les directeurs des établissements de transfusion sanguine pour l’exercice de cette mission.
