By way of derogation from the provisions of Article R. 5124-3, manufacturers and importers of medicinal products may only distribute investigational medicinal products and, where applicable, ancillary medicinal products used for the purposes of a clinical trial within the meaning of Regulation (EU) No 536/2014 of the European Parliament and of the Council of 16 April 2014 on clinical trials on medicinal products for human use and repealing Directive 2001/20/EC, which they stock to distributors of investigational medicinal products, pharmacists referred to in Articles L. 5126-11 and L. 5126-12, pharmacists managing a pharmacy for internal use in an army hospital, pharmacists in authorised premises within the meaning of article L. 1121-13, where applicable, or, in other cases, investigators as defined in article L. 1121-1, or natural or legal persons authorised to carry out similar activities outside national territory.
Distributors of investigational medicinal products may only distribute these medicinal products to the pharmacists mentioned in articles L. 5126-11 and L. 5126-12, to pharmacists managing a pharmacy for internal use in an army hospital or, in other cases, to the investigators defined in article L. 1121-1, to pharmacists in authorised premises within the meaning of article L. 1121-13, where applicable, or to natural or legal persons authorised to carry out similar activities outside national territory.
When biomedical research is carried out outside an establishment mentioned in article L. 5126-1 which has an in-house pharmacy, investigators defined in article L. 1121-1 may exceptionally make investigational medicinal products available to other investigators. It is mentioned in the elements of the protocol provided for in article R. 1123-20 and is carried out in agreement with the sponsor and in compliance with the good clinical practice provided for in article L. 1121-3.
In the context of biomedical research, manufacturers and importers of medicinal products other than investigational medicinal products, operators, stockists and wholesaler-distributors may distribute the medicinal products or products which they stock to other authorised establishments engaged in the manufacture of investigational medicinal products on behalf of a sponsor or, where applicable, to the pharmacists mentioned in articles L. 5126-11 and L. 5126-12, pharmacists managing a pharmacy for internal use in an army hospital, or pharmacists in research sites authorised under article L. 1121-13.
