Article R5124-30 of the French Public Health Code

In application of article L. 5124-4, a pharmacist delegate is replaced under the following conditions:

1° By the interim pharmacist delegate designated by the competent authority mentioned in articles R. 5124-23 to R. 5124-28-1 ;

2° Or, failing that, by an assistant pharmacist from the same company or organisation or by a pharmacist who has no other professional activity for the duration of the replacement ;

3° Or, failing this, for establishments dependent on companies or organisations mentioned in 4° to 12°, 14° and 15° of article R. 5124-2, by a pharmacist who has applied for registration on the roll of one of the sections of the Ordre National des Pharmaciens pending a decision on his application and who has no other professional activity for the duration of the replacement.

Article R5124-30

En application de l’article L. 5124-4, le remplacement d’un pharmacien délégué est assuré dans les conditions suivantes :

1° Par le pharmacien délégué intérimaire désigné par l’autorité compétente mentionnée aux articles R. 5124-23 à R. 5124-28-1 ;

2° Ou, à défaut, par un pharmacien adjoint de la même entreprise ou du même organisme ou par un pharmacien n’ayant pas d’autre activité professionnelle pendant la durée du remplacement ;

3° Ou, à défaut, pour les établissements dépendant d’entreprises ou organismes mentionnés aux 4° à 12°, au 14° et au 15° de l’article R. 5124-2, par un pharmacien ayant sollicité son inscription au tableau de l’une des sections de l’ordre national des pharmaciens en attendant qu’il soit statué sur sa demande et n’ayant pas d’autre activité professionnelle pendant la durée du remplacement.
