Article R5124-5 of the French Public Health Code

The procedures for submitting and examining applications for authorisation to open, for modification of initial authorisations and for transfer of authorisations to open, as provided for in Articles R. 5124-6, R. 5124-7, R. 5124-10, R. 5124-10-1, R. 5124-10-2, R. 5124-13 and R. 5124-14 , as well as the content of the file attached to the application, are laid down by decision of the Director General of the Agence nationale de sécurité du médicament et des produits de santé.

The file referred to in the first paragraph includes, in particular, information, accompanied by supporting documents, relating to the company name, legal form, registered office of the company and the establishment, as well as the pharmacist responsible for it, and a description of the establishment and its operating conditions.

The procedures for applications concerning the pharmaceutical establishments of the central armed forces pharmacy and the medical supply establishments of the armed forces health service are laid down, on a proposal from the Director General of the Agency, by order of the ministers responsible for the armed forces and health.

Les modalités de présentation et d’instruction des demandes d’autorisation d’ouverture, de modification des autorisations initiales et de transfert des autorisations d’ouverture prévues aux articles R. 5124-6, R. 5124-7, R. 5124-10, R. 5124-10-1, R. 5124-10-2, R. 5124-13 et R. 5124-14 , ainsi que le contenu du dossier joint à la demande, sont fixées, par décision du directeur général de l’Agence nationale de sécurité du médicament et des produits de santé.

Le dossier mentionné au premier alinéa comprend notamment les renseignements, accompagnés des pièces justificatives, relatifs à la dénomination sociale, à la forme juridique, au siège social de l’entreprise et de l’établissement, ainsi qu’au pharmacien responsable de celui-ci, et la description de l’établissement et de ses conditions de fonctionnement.

Les modalités des demandes concernant les établissements pharmaceutiques de la pharmacie centrale des armées et des établissements de ravitaillement sanitaire du service de santé des armées sont fixées, sur proposition du directeur général de l’agence, par arrêté des ministres chargés des armées et de la santé.
