Article R5124-60-2 of the French Public Health Code

I.-The pharmaceutical establishment of a company or organisation mentioned in 1° to 5° and 8° of article R. 5124-2 engaged in wholesale, free transfer or wholesale distribution checks the safety devices mentioned in article R. 5121-138-2 and deactivates the unique identifier mentioned in this same article before dispensing the medicinal products mentioned in article R. 5121-138-1:

1° To the practitioners mentioned in article R. 5124-43 ;

2° Veterinarians and organisations mentioned in article R. 5124-44 ;

3° Companies or organisations mentioned in 1° to 19° of Article R. 5124-45;

4° Establishments providing medical supplies for the armed forces health service, as mentioned in article L. 5124-8;

5° The armed forces health service medical centres mentioned in article L. 6326-1 ;

6° The pharmaceutical establishments of the National Public Health Agency mentioned in article L. 1413-4;

7° the fire and rescue services referred to in article L. 1424-1 of the General Local Authorities Code, the Marseilles marine fire brigade referred to in article R. 2513-5 of the same code and the Paris fire brigade referred to in article R. 1321-19 of the Defence Code.

II – When the authenticity and deactivation of the unique identifier of a medicinal product is verified, in application of I, before the medicinal product is supplied to the public, the integrity of the tamper-evident device is verified when the medicinal product is supplied to the public.

Article R5124-60-2

I.-L’établissement pharmaceutique d’une entreprise ou d’un organisme mentionné aux 1° à 5° et au 8° de l’article R. 5124-2 se livrant à la vente en gros, à la cession à titre gratuit ou à la distribution en gros vérifie les dispositifs de sécurité mentionnés à l’article R. 5121-138-2 et désactive l’identifiant unique mentionné à ce même article avant de délivrer les médicaments mentionnés à l’article R. 5121-138-1 :

1° Aux praticiens mentionnés à l’article R. 5124-43 ;

2° Aux vétérinaires et organismes mentionnés à l’article R. 5124-44 ;

3° Aux entreprises ou organismes mentionnés aux 1° à 19° de l’article R. 5124-45 ;

4° Aux établissements de ravitaillement sanitaire du service de santé des armées mentionnés à l’article L. 5124-8 ;

5° Aux centres médicaux du service de santé des armées mentionnés à l’article L. 6326-1 ;

6° Aux établissements pharmaceutiques de l’Agence nationale de santé publique mentionnés à l’article L. 1413-4 ;

7° Aux services d’incendie et de secours mentionnés à l’ article L. 1424-1 du code général des collectivités territoriales , au bataillon des marins-pompiers de Marseille mentionné à l’article R. 2513-5 du même code et à la brigade des sapeurs-pompiers de Paris mentionnée à l’ article R. 1321-19 du code de la défense .

II.-Lorsque la vérification de l’authenticité et la désactivation de l’identifiant unique d’un médicament est effectuée, en application du I, avant le moment où le médicament est délivré au public, l’intégrité du dispositif antieffraction est vérifiée au moment où le médicament est délivré au public.
