Article R5124-62 of the French Public Health Code

The depositories defined in 4° of article R. 5124-2 carry out their activities under the conditions set out in a written contract which, in accordance with the good practices provided for in article L. 5121-5, applicable to these activities, sets out the respective obligations of the depository and the operator, manufacturer or importer on whose behalf it is acting. They may only distribute batches of medicinal products or other pharmaceutical products which have been released by the pharmacist in charge of the company or organisation which manufactures or imports them.

Depositaries may, on behalf of one or more operators of medicinal products, store and deliver samples of medicinal products to the healthcare professionals mentioned in article L. 5122-10. They report on the dispatch of these samples to these operators.

Les dépositaires définis au 4° de l’article R. 5124-2 exercent leurs activités dans les conditions prévues par un contrat écrit qui fixe, conformément aux bonnes pratiques prévues à l’article L. 5121-5, applicables à ces activités, les obligations respectives du dépositaire et de l’exploitant, du fabricant ou de l’importateur pour le compte duquel il agit. Ils ne peuvent distribuer que des lots de médicaments ou autres produits pharmaceutiques ayant fait l’objet d’une libération par le pharmacien responsable de l’entreprise ou organisme qui en assure la fabrication ou l’importation.

Les dépositaires peuvent assurer, pour le compte d’un ou plusieurs exploitants de médicaments, le stockage et la livraison d’échantillons de médicaments aux professionnels de santé mentionnés à l’article L. 5122-10. Ils rendent compte de l’envoi de ces échantillons à ces exploitants.
