Article R5124-63 of the French Public Health Code

The approval of a not-for-profit humanitarian organisation as provided for in article L. 5124-7 is granted by the Minister for Health, after obtaining the opinion of the Minister for Humanitarian Action and, depending on the location of the proposed pharmaceutical establishment, of the Central Council of Section C or E of the National Order of Pharmacists.

If the Minister remains silent on the application for approval for more than four months, this is deemed to constitute a rejection decision.

L’agrément d’un organisme à but non lucratif et à vocation humanitaire prévu à l’article L. 5124-7 est accordé, après avis du ministre chargé de l’action humanitaire et, selon le lieu d’implantation de l’établissement pharmaceutique envisagé, du conseil central de la section C ou E de l’ordre national des pharmaciens, par le ministre chargé de la santé.

Le silence gardé pendant plus de quatre mois par le ministre sur la demande d’agrément vaut décision de rejet.
