Article R5124-73 of the French Public Health Code

Where a public health care institution sets up several pharmaceutical establishments, each of these establishments is placed under the control of a delegated pharmacist who ensures compliance with the provisions of this section under the authority of the pharmacist in charge.

Where the pharmacist in charge performs his duties in one of the pharmaceutical establishments, the appointment of a delegated pharmacist is not compulsory in that establishment.

The delegate pharmacist is chosen from the staff mentioned in 1° and 2° of article L. 6152-1. He is appointed, with the agreement of the pharmacist in charge, by the general manager or the director of the public health establishment for a maximum renewable period of three years.

At the request of the pharmacist in charge or after obtaining his opinion, the director or general manager of the health establishment may, in the interests of the smooth running of the pharmaceutical establishment, terminate the duties of the delegated pharmacist after hearing him.

Lorsqu’un établissement public de santé crée en son sein plusieurs établissements pharmaceutiques, chacun de ceux-ci est placé sous le contrôle d’un pharmacien délégué qui veille au respect des dispositions de la présente section sous l’autorité du pharmacien responsable.

Lorsque le pharmacien responsable exerce ses fonctions dans l’un des établissements pharmaceutiques, la désignation d’un pharmacien délégué n’est pas obligatoire dans cet établissement.

Le pharmacien délégué est choisi parmi les personnels mentionnés au 1° et au 2° de l’article L. 6152-1. Il est désigné, avec l’accord du pharmacien responsable, par le directeur général ou le directeur de l’établissement public de santé pour une durée maximum de trois ans renouvelable.

A la demande du pharmacien responsable ou après avoir recueilli son avis, le directeur ou le directeur général de l’établissement de santé peut, dans l’intérêt du bon fonctionnement de l’établissement pharmaceutique, mettre fin aux fonctions du pharmacien délégué après l’avoir entendu.
