I.-The categories of magistral preparations that may be subcontracted by a dispensing pharmacy to a pharmaceutical establishment authorised to manufacture medicinal products are :
1° Preparations obtained from homeopathic strains, according to a homeopathic manufacturing process described by the European pharmacopoeia, the French pharmacopoeia or, failing that, by the pharmacopoeias officially used in another Member State of the European Union;
2° Preparations that may present a health risk, as mentioned in the Order of the Minister for Health provided for in Article L. 5125-1-1.
II-The written subcontracting contract referred to in the third paragraph of Article L. 5125-1 between a pharmacy and a pharmaceutical establishment is drawn up in compliance with the good preparation practices referred to in Article L. 5121-5.
III -An annual statement of subcontracting contracts for the preparations mentioned in 2° of I, indicating the contact details of the subcontracting manufacturers, the categories and pharmaceutical forms of the subcontracted preparations and the active substances they contain, is drawn up by the pharmacist holding the dispensary by 31 March of the following year at the latest. At the request of the Director General of the Regional Health Agency, this report is sent to the Director General of the Regional Health Agency by the pharmacist holding the pharmacy on whose behalf the subcontracting is carried out.
IV -The pharmaceutical establishment’s subcontracting activity is mentioned in the document provided for in article R. 5124-46, which includes, in particular, a quantitative summary of the preparations made, by category of preparation and by pharmaceutical form.
