Article R5126-59 of the French Public Health Code

I.-Medicinal products meeting the following conditions may be included on the list provided for in article R. 5126-58:

1° They benefit from a marketing authorisation, a parallel import authorisation mentioned in article R. 5121-116 or an import authorisation issued in application of article R. 5121-108 in the context of a stock shortage, a risk of a stock shortage or a marketing stoppage or be the subject of parallel distribution within the meaning of article L. 5124-13-2;

2° Be subject to the provisions of Section 1 of Chapter II of Title III of this Book;

3° Not be classified in the category of medicinal products reserved for hospital use.

II – Medicinal products are entered on the list under the name defined in article R. 5121-2. The registration also mentions the name of the company or organisation responsible for its operation or parallel distribution.

Article R5126-59

I.-Peuvent être inscrits sur la liste prévue à l’article R. 5126-58 les médicaments répondant aux conditions suivantes :

1° Bénéficier d’une autorisation de mise sur le marché, d’une autorisation d’importation parallèle mentionnée à l’article R. 5121-116 ou d’une autorisation d’importation délivrée en application de l’article R. 5121-108 dans le cadre d’une rupture de stock, d’un risque de rupture ou d’un arrêt de commercialisation ou faire l’objet d’une distribution parallèle au sens de l’article L. 5124-13-2 ;

2° Etre soumis aux dispositions de la section 1 du chapitre II du titre III du présent livre ;

3° Ne pas être classés dans la catégorie de médicaments réservés à l’usage hospitalier.

II.-Les médicaments sont inscrits sur la liste sous la dénomination définie à l’article R. 5121-2. L’inscription mentionne également le nom de l’entreprise ou de l’organisme qui en assure l’exploitation ou la distribution parallèle.
