I.-When the replacement of a pharmacist practising in a pharmacy for internal use, other than the pharmacist in charge of management, cannot be provided under the conditions set out in articles R. 5126-54, R. 5126-84 or R. 5126-104, it may be carried out by pharmacy interns and by interns and assistant pharmacists in army hospitals who have completed:
1° The entire second cycle of pharmaceutical studies in France;
2° Five semesters of training for the specialised pharmacy studies diploma carried out as part of the third specialised cycle of pharmaceutical studies, in each of the four fields of pharmacy.
In this case, the president of the conseil central de l’ordre des pharmaciens will issue the intern with a certificate to be given to the director of the establishment and, where applicable, to the pharmacist managing the pharmacy for internal use, certifying that he fulfils the conditions laid down for this replacement: the issue of this certificate is subject, as far as the evidence of studies carried out is concerned, to a certificate issued to the intern by the director of the training and research unit with which he is registered with a view to obtaining the State diploma of doctor of pharmacy. This certificate is valid for one year throughout France. It may be renewed under the same conditions, on proof of continuation of the same studies.
In the case of interns and assistant pharmacists in army hospitals, this certificate is issued by the Minister of Defence.
II.-When the pharmacist managing a pharmacy for internal use cannot be replaced under the conditions provided for in articles R. 5126-40, R. 5126-83, R. 5126-93 or R. 5126-103, he may be replaced by pharmacy interns and by interns and assistant pharmacists in army hospitals under the conditions provided for in I.
In this case, the replacement is subject to the signing of an assistance agreement between the establishment to which the internal-use pharmacy in which the replacement is carried out is attached and an establishment in which the internal-use pharmacy is managed, for the duration of the replacement, by a pharmacist.
The maximum duration of replacement that may be carried out by pharmacy interns and interns and assistant pharmacists in army hospitals is four months per year, subject to a limit of one month per replacement.
An order of the ministers responsible for health and defence sets the content of the agreement provided for in the second paragraph of II.
