Article R513-10-6 of the French Public Health Code

For the purposes of this section, :

“Misuse”: use that does not comply with the intended purpose of the product, its usual use or its instructions for use, or with the special precautions for use mentioned in 7° of article R. 513-10-5;

Adverse reaction”: a noxious and unintended response occurring under normal conditions of use of a tattooing product or resulting from misuse of such a product; “Serious adverse reaction”: a noxious and unintended response occurring under normal conditions of use of a tattooing product or resulting from misuse of such a product;

“Serious adverse reaction”: a noxious and unintended response, whether occurring under the normal conditions of use of the product in humans or resulting from misuse, that would require hospitalisation or that would lead to permanent or temporary functional incapacity, disability, immediate life-threatening condition, death or congenital anomaly or malformation.

Pour l’application de la présente section, on entend par :

” Mésusage ” : une utilisation non conforme à la destination du produit, à son usage habituel ou à son mode d’emploi, ou aux précautions particulières d’emploi mentionnées au 7° de l’article R. 513-10-5 ;

” Effet indésirable ” : une réaction nocive et non recherchée, se produisant dans les conditions normales d’emploi d’un produit de tatouage ou résultant d’un mésusage d’un tel produit ;

” Effet indésirable grave ” : une réaction nocive et non prévisible, qu’elle se produise dans les conditions normales d’emploi du produit chez l’homme ou qu’elle résulte d’un mésusage, qui soit justifierait une hospitalisation, soit entraînerait une incapacité fonctionnelle permanente ou temporaire, une invalidité, une mise en jeu du pronostic vital immédiat, un décès ou une anomalie ou une malformation congénitale.
