Article R513-10-9 of the French Public Health Code

The vigilance exercised over tattooing products includes :

1° The immediate reporting of the serious adverse reactions mentioned in article L. 513-10-8, including those resulting from misuse, and the collection of information concerning them, as well as the collection of information mentioned in article R. 513-10-12 ;

1° bis The reporting of other adverse reactions, including those resulting from misuse of the product;

2° The recording, evaluation and use of this information with a view to prevention; this information is analysed taking into account available data concerning the sale and use of tattoo products;

3° Carrying out all studies and work relating to the safe use of these products;

4° Carrying out and monitoring corrective actions.

Vigilance may involve research and analysis of the data contained in the file provided for in article R. 513-10-3.

Article R513-10-9

La vigilance exercée sur les produits de tatouage comporte :

1° La déclaration sans délai des effets indésirables graves mentionnés à l’article L. 513-10-8, y compris ceux résultant d’un mésusage et le recueil des informations les concernant ainsi que le recueil des informations mentionnées à l’article R. 513-10-12 ;

1° bis La déclaration des autres effets indésirables, y compris ceux résultant d’un mésusage du produit ;

2° L’enregistrement, l’évaluation et l’exploitation de ces informations dans un but de prévention ; ces informations sont analysées en prenant en compte les données disponibles concernant la vente et les pratiques d’utilisation des produits de tatouage ;

3° La réalisation de toutes études et de tous travaux concernant la sécurité d’emploi de ces produits ;

4° La réalisation et le suivi des actions correctrices.

L’exercice de la vigilance peut impliquer la recherche et l’analyse des données contenues dans le dossier prévu à l’article R. 513-10-3.
